Two petitioners seek bail in connection with Chabilapur P.S. Case No.62 of 2018 registered for the offence under Sections 409, 420 and 34 of the Indian Penal Code. On the basis of written information of Block Development Officer that on enquiry from the beneficiaries, namely, Sita Devi, Gudiya Devi and Mansa Devi by the Media regarding "Pradhanmantri Awas Yojna" they had complained that after withdrawal of first installment of Rs.50,000/- under the scheme, the petitioner Chunchun and Mukhiya Santosh Kumar Diwakar took Rs.15,000/-forcibly, as a result of which their house could not be completed, on the basis of which the
Patna High Court CR. MISC. No.3953 of 2020(2) dt.22-01-2020 2/3 present F.I.R. was lodged.
It is submitted on behalf of the petitioner that the petitioners have falsely been implicated in the present case due to political rivalry. It is also submitted that during investigation, several witnesses have been examined but they have not supported the allegation as made against the petitioners. It is submitted that final form has been submitted showing lack of evidence. It is further submitted that information is based on the basis media report but the petitioners' name does not find place in the F.I.R..The petitioner is in custody since 21.11.2019 having no criminal antecedent.
Considering the aforesaid facts and circumstances and, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.V, Nalanda at Biharsharif in connection with Chhabilapur P.S. Case No. 62 of 2018 on the following conditions:-
(1) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and their absence on two consecutive dates without sufficient

(2) If the petitioners tamper with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
