JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2019 This is an application for grant of anticipatory bail in connection with K. Nagar (Srinagar) P.S. Case No. 612 of 2017, disclosing offences under Sections 302, 201, 34 of the Indian Penal Code and Section 4 of the POCSO Act.
Allegation as per F.I.R. is that the minor daughter of the informant had gone to Bahiyar, but she did not return back and when the informant went in search of her, he found the dead-body of his daughter in a pond and he saw three persons fleeing away and one Md. Aftab disclosed their names. Submission of learned counsel for the petitioner is that he is not named in the F.I.R. and after six months of the occurrence, name of the petitioner disclosed that he was also seen fleeing away from the place of occurrence and except that

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge (POCSO) Act, Purnea, in connection with K. Nagar (Srinagar) P.S. Case No. 612 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
