The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467,468,471,420 and 120B of the Indian Penal Code. The prosecution case is that the informant purchased the land pertaining to Khata no. 40, Plot No. 614 area 9-7/3 decimals from Kalawati Devi by registered sale deed dated 30.6.1990, thereafter name of the informant was mutated and rent receipt was issued in her favour. On 25.8.2014 when the informant went to see her land then other accused persons conveyed that this land has been transferred in favour of the Hon'ble Governor by the co accused Ramji Singh.
Thereafter, the
Patna High Court Cr.Misc. No.16668 of 2016 (2) dt.19-04-2016 2/3 informant inquired from the registry office and found that maliciously Ramji Singh being maternal grand son of Kalawati Devi transferred the land. It is alleged against the petitioner that he is witness to the sale deed. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against Ramji Singh who has been granted bail by a co-ordinate bench of this court vide Cr. Misc. No. 11341 of 2016. It is further submitted that the petitioner bonafidely became the witness to the transfer deed of the land in question as ancestral land of Ramji Singh. The petitioner was not aware of the transfer made by Kalawati Devi in favour of the informant.
Considering the thrust of accusation against co accused Ramji Singh who has been granted anticipatory bail, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Jamui P.S. Case No. 294 of 2014 subject
