JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-06-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 392 and 411 of the I.P.C, sections 25 (1b) A, 26 and 35 of the Arms Act and section 17 of the Criminal Law Amendment Act.

Allegedly, four unknown miscreants, out of whom one pointing out pistol demanded cash from the informant and his associates and snatched cash of Rs. 200/- from pocket of the informant, Rs. 75/- from Ravindra Bhuiya, Rs. 130/- from Yogendra Bharti, but due to timely arrival of police party the petitioner and other co-accused were apprehended and from possession of the petitioner one loaded country made katta and

Patna High Court Cr.Misc. No.18355 of 2016 (3) dt.29-06-2016 2/2 two live cartridges besides one mobile were recovered. Submission is of false implication, other co-accused, namely, Pachu Yadav, Lokesh Kumar Yadav and Janki Yadav have already been allowed bail which is evident from Annexure-2 and the petitioner who is suffering in custody since 22.09.2015 now has been sufficiently penalized.

The learned A.P.P. submits that the petitioner has got criminal antecedent.

In the facts and circumstances as stated above, considering detention of the petitioner, now he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri J.N. Dubey, J.M. 1st Class, Sherghati at Gaya in Suhail P.S. Case No. 11 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
