The petitioner seeks regular bail in connection with Barauni Rail P.S. Case No. 117 of 2018, registered for the offence punishable under Section 394 of the Indian Penal Code.
The allegation is regarding unknown persons having stolen the bag of a passenger travelling in the train i.e. from the informant herein and had fled away.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and no Test Identification Parade has been held till date. It is further submitted that the petitioner is ready to abide by whatsoever conditions which is thought proper by this Court
Patna High Court Cr.Misc. No.2463 of 2019(2) dt.18-01-2019 2/2 to be imposed for the purposes of grant of bail, especially in view of the fact that similar type of cases is pending against the petitioner herein though he is on bail in the said cases. The petitioner is stated to be in custody since 12.10.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rly. Barauni, DistrictBegusarai in connection with Barauni Rail P.S. Case No. 117 of 2018.
It is further directed that in case, the petitioner is, henceforth, implicated in similar type of case, the present privilege of bail shall stand cancelled automatically. (Mohit Kumar Shah, J) ajay gupta/- U T
