04-03-2020 Heard learned counsel for the parties.

The petitioner apprehends her arrest in G.R. No. 2405 of 2019, arising out of Laxmipur P.S. Case No. 316 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

The F.I.R. has been lodged against nine accused persons alleging therein that all the accused persons including petitioner entered into the house of informant, variously armed with certain weapons, and assaulted the informant side. It is submitted on behalf of petitioner that specific allegation of assault by sword is against co-accused Sanjay Kumar. So far as this petitioner is concerned, it is alleged that she assaulted with garasa. Petitioner is lady and has got no criminal antecedent.

Patna High Court CR. MISC. No.4335 of 2020(2) dt.04-03-2020 2/2 However, learned counsel for the informant has vehemently opposed the prayer for bail. It was submitted that petitioner was one of the participants in the aforesaid occurrence.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of her arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar Raj, learned Judicial Magistrate, Jamui in connection with G.R. No. 2405 of 2019, arising out of Laxmipur P.S. Case No. 316 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
