JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354-B, 504, 379, 427, 337 and 506 of the Indian Penal Code.
It is a case of assault upon the informant due to which the informant and others sustained injuries.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the injury report is not genuine. Learned APP appearing for the State opposed the anticipatory bail and submitted that there is direct allegation of
Patna High Court CR. MISC. No.5126 of 2022(4) dt.02-08-2022 2/2 assault to the informant, namely, Rajan Kumar Singh by this petitioner by means of Dabia and from perusal of injury report of the informant shows that injuries are grievous in nature and fracture on forehead.
Considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is rejected.
However, the petitioner is directed to surrender before the court below and pray for regular bail.
