The present application has been listed in view of I.A. No. 1017 of 2015 whereby prayer has been made for taken up the matter out of turn since the petitioner has to appear before the Railway Recruitment Cell for verification of his documents for being recruited on Class IV post. The petitioner is languishing in custody since 11.05.2015 in a case registered for the offences punishable under Sections 419 and 420/34 of the Indian Penal Code. It is alleged against the petitioner that he found appearing at ITI CAT examination in place of co-accused
Patna High Court Cr.Misc. No.27548 of 2015 (2) dt.21-07-2015 2/2 Rakesh Ranjan Kumar.
It is submitted by learned counsel for the petitioner that under some misconception petitioner appeared at the said examination and the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the investigation has already concluded and the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sohsarai P.S. Case No. 80 of 2015.
Accordingly, I.A. No. 1017 of 2015 as well as Cr. Misc. No. 27548 of 2015 are disposed of.
