2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Bhabua P.S. Case No.787 of 2024, lodged on 01.10.2024, under Sections 316(2)/3(5)/318(4)/319(2) of B.N.S. Act.

3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner with allegation that the accused persons used to take money from the informant in the name of providing services. Allegation against the present petitioner is that he has taken three lakhs cash.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner is actually victim of this case since wrong has been committed by his uncle and due to this reason with a view to teach lesson his name has also been inserted in this case. Counsel submits that antecedent of the petitioner is clean.

5. Learned Counsel for the informant vehemently opposes the prayer for bail and submits that the informant had paid money amounting to Rs.9,84,200/- and Rs. 3,00,000/- to the petitioner.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

7. In the present facts and circumstances, this Court is no inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby rejected. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
