2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections-147, 341,
Patna High Court CR. MISC. No.8756 of 2024(3) dt.12-07-2024 2/3 323, 353, 224, 225, 504/34 of the Indian Penal Code.
3. As per allegation, the informant, who is SHO of police outpost proceeded in course of enquiry of an application along with police force. While the informant reached near the house of Subash Pandit, in course of an inquiry, accused Subhash Pandit was found standing on PCC road in front of his house and from his mouth smell of liquor was coming. It is further alleged he started abusing the police officials and a scuffle took place between Subhash Pandit and the police officials. The said Subhash Pandit was apprehended and he was being taken to hospital for his breath analyzer test, the accused persons including the petitioners surrounded the police vehicle and some persons succeeded in rescue the apprehended accused Subhash Pandit.

The learned counsel for the petitioners has submitted that the petitioners have got no criminal antecedents and they have falsely been implicated in the present case merely because they are the co-villagers of co-accused Subhash Pandit. Some of the coaccused persons having similar allegation, have already been granted anticipatory bail by this court.
5. Considering the above-mentioned facts and circumstances coupled with the fact that the petitioners are the persons of clean antecedents, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court
Patna High Court CR. MISC. No.8756 of 2024(3) dt.12-07-2024 3/3 below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned Court, East Champaran Motihari in connection with Raxaul (Haraiya) P.S. Case No. 479 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
