Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 272/273/34 of the Indian Penal Code and Sections 30(a), 34, 36, 38, 41 and 56(D) of the Bihar Prohibition and Excise Act.

Petitioner is driver of the truck from which huge quantity of liquor was recovered. Petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 21.11.2019. In the past, prayer for bail was refused by order at Annexure-1 with liberty to renew prayer for bail after completion of one year of judicial custody.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.16427 of 2021(2) dt.13-08-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Maniyari P.S. Case No. 310 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
