The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code and Sections 3 / 4 of the POCSO Act.
The mother of the deceased alleged that her daughter had gone to cut grass but she did not return. Her dead body was found. The informant suspected the hands of the petitioner and other accused persons but there appears that there is no material to show the involvement of the petitioner except suspicion. Considering the facts that the name of the petitioner figured in the confessional statement of a co-accused and no other tangible evidence has been collected showing involvement of the petitioner in the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten
Patna High Court Cr.Misc. No.26441 of 2015 (2) dt.24-07-2015 2/2 thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st - cum - Special Court, Khagaria in Gogri P.S. Case No. 64/15, corresponding to G.R. No. 452/15.
