JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-06-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Special Case No. 02 of 2016 arising out of Vigilance Case No. 07 of 2016 registered for the offences punishable under Sections 7/13(2) read with 13(1)(d) of Prevention of Corruption Act. Allegedly, the petitioner being I.O. of Laxmipur (Gidhaur) P.S. Case No. 198 of 2015 demanded bribe of Rs. 10,000/- from the complainant Laxman Kumar Saw which was found true during verification and the petitioner was caught raid handed accepting the bribe money of Rs. 6500/-. Submission is of false implication and that he has been made victim of the circumstances, charge-sheet has already been submitted and there is no chance of tampering with

Patna High Court Cr.Misc. No.18312 of 2016 (3) dt.28-06-2016 2/2 prosecution evidence the petitioner by remaining in custody since 20.01.2016 has been sufficiently penalized at this stage. Learned counsel representing the Vigilance opposes the prayer of bail.

In the facts and circumstances stated above, considering the period of detention and further that there is no chance of tampering with prosecution evidence, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Special Judge, Trap, Patna, in connection with Special Case No. 02 of 2016 arising out of Vigilance case no. 07 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
