JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Maniyari P.S. Case No. 315 of 2019, registered for offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and Sections 30(a)/34/36/38/41 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 34.80 litres of foreign liquor from the house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the petitioner. Further he has no criminal antecedent and has been in judicial custody since 29.11.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let

Patna High Court CR. MISC. No.5016 of 2020(2) dt.31-01-2020 2/2 the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Maniyari P.S. Case No. 315 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
