The petitioner has filed the instant petition under Article 227 of the Constitution of India seeking direction to the learned Principal Judge, Family Court, Siwan to dispose of the petition dated 14.11.2022 filed in Maintenance Case No.179 of 2007 under Section 125 of the Code of Criminal Procedure for alteration of maintenance amount at the earliest.

3. The learned counsel for the petitioner submits that the said petition has been filed on 14.11.2022, but the same is not being disposed of by the learned Principal Judge, Family Court, Siwan and the petitioner is facing hardship since the maintenance amount fixed earlier is quite meagre and the petitioner is not able to maintain herself as well as her children

Patna High Court C.Misc. No.124 of 2023 dt.16-05-2024 2/2 out of the maintenance amount of Rs.3,000/-.

4. Since the only prayer of the petitioner is for expeditious disposal of the petition pending before the learned Principal Judge, Family Court, I do not think there is any need to issue notice to the respondent and the present matter could be disposed of straightaway.

5. Having considered the aforesaid facts and circumstances as well as submission made on behalf of the petitioner, the learned Principal Judge, Family Court, Siwan is directed to dispose of the aforesaid petition filed by the petitioner in Maintenance Case No. 179 of 2007 on its merits and in accordance with law preferably within a period of six months from the date of receipt/production of a copy of this order.
