JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Naubatpur P.S. Case No. 588 of 2015, registered under Section 302, 201/34 of the Indian Penal Code.
The accusation is that father of the informant moved from his house in the evening of 22.09.2015 after giving information that he is going to Patna with this petitioner, who was the tenant in his house, but his father did not return. On 25.09.2015, informant came to know that a unknown dead body is lying in the Naubatpur P.S. then he went there, where he identified the dead body of his father Ram Balak Singh. The informant raised suspicion against the petitioner along with
Patna High Court Cr.Misc. No.19496 of 2016 (2) dt.06-05-2016 2/2 Manoj Choudhary and Om Prakash that they committed murder of his father with a view to grab the money of land business. Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. merely on suspicion except the suspicion, there is no tangible material against the petitioner whatsoever to show his involvement in the present case. The petitioner is an accused in five other cases, but he is on bail. The petitioner is in custody since 15.12.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Danapur, Patna in connection with Naubatpur P.S. Case No. 588 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
