JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is apprehending his arrest in connection with Rampur P.S. Case No. 48 of 2015 for the offences instituted under Sections 2(e), 3 and 5(f) of the Mahua Flower Act and 47(f) and 48 of the Excise Act.

Heard learned counsel for the petitioner and learned counsel for the State.

It is alleged that 200 Kgs. of Mahua flowers were seized from a pick-up van in which the petitioner is said to be driver.

It has been submitted on behalf of the petitioner that no specific allegation has been made against the petitioner. It is further submitted that the petitioner is said to be the driver of the

Patna High Court Cr.Misc. No.26231 of 2015 (2) dt.17-07-2015 2/2 vehicle from which four bags of mahua flowers is said to have been recovered. It is further submitted that the petitioner has got no criminal antecedent and he has falsely been implicated in the present case due to mistake of fact.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Rampur P.S. Case No. 48 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
