JUSTICE AMARESH KUMAR LAL ORAL ORDER 04-06-2015 All these applications arise out of Brahmpura P. S. Case No. 208 of 2014 registered for the offence punishable under Sections 363 and 365 IPC. Later on, 364(A) IPC had been added.

Heard.

The petitioners seek bail in the aforesaid case. It is submitted that FIR was lodged against unknown. During investigation, the name of petitioner Bablu Paswan has appeared in the confessional statement of Randhir Kumar,

3/4 name of petitioner Deepak Sahni has appeared in suspicion, names of petitioners Laxmi Devi and Sunil Kumar @ Mani have appeared in the statement of the spy. The victim has returned but he has not named any of the accused. The petitioners have no criminal antecedent. In similar facts and circumstances, Prem Kumar @ Parmindra and Randhir Kumar and Md. Shashad Alam have been granted bail by this Court vide Cr. Misc. Nos. 14184 of 2015, 14206 of 2015 and 8973 of 2015 respectively.

Considering the facts and circumstances, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Vth Additional Session Judge at Muzaffarpur/court concerned in Session Trial No. 38 of 2015 arising out of Brahmpura P. S. Case No. 208 of 2014 with following conditions:-

1. The petitioners will not indulge themselves in similar or any other offence.

2. One of the bailors must be the close relative of the petitioners.

3. The petitioners will be well represented in the

4/4 Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, their bail bonds would be liable to be cancelled by the learned Court concerned.
