The petitioner seeks regular bail in connection with Lakhisarai P.S. Case No. 151 of 2019 for the offence punishable under Section 392 of the Indian Penal Code.

The allegation is regarding unknown miscreants having intercepted the informant and snatched a sum of Rs. 5000/-, one mobile phone and his motorcycle.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 10.09.2019. It is also submitted that no test identification parade has been held so as to implicate the petitioner in the alleged occurrence.

No.3384 of 2020(2) dt.21-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that no test identification parade has taken place so as to connect the petitioner with the alleged occurrence, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai P.S. Case No. 151 of 2019.
