JUSTICE SANJAY PRIYA ORAL ORDER 2/ 06-02-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Complaint Case No.30370-C of 2014 instituted for the offence under Section(s) 498-A Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Counsel for the petitioner submits that petitioner always want to keep the Complainant, but she is not ready to live with him. Petitioner has filed petition for restitution of conjugal rights vide Case No.882 of 2013 in the Court of the Principal Judge, Family Court, Patna, which is still pending. It is also submitted that petitioner has filed Information Petition No.161-M of 2013 dated 13.11.2013, bringing on record the
Patna High Court Cr.Misc. No.6755 of 2019(2) dt.06-02-2019 2/2 wrongful acts of the Complainant and her family members. The Sessions Judge has mentioned in the impugned order that on query by the Complainant she did not become ready to go with the petitioner.
Petitioner is in custody since 29.09.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub- Divisional Judicial Magistrate, Patna, in connection with Complaint Case No.30370-C of 2014, subject to the condition that both the bailors shall be close relative of the petitioner.
