Petitioner is in custody in connection with Bairiya P.S. Case No. 195 of 2018 for the offence under sections 406, 420, 467, 468, 441, 323/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. He submits that petitioner is purchaser for value consideration.
Referring to the prosecution case, he submits that the allegation against this petitioner is that he got the sale deed in his favour in connivance with the husband of the daughter of the informant.
Learned counsel submits that deed was executed and
Patna High Court Cr.Misc. No.4333 of 2019(2) dt.28-01-2019 2/2 registered in presence of Registrar. However, from the sale deed it does not appear that the manner in which the consideration money was paid.
Considering the totality of the facts and circumstances, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIIth, Bettiah, West Champaran, in connection with Bairiya P.S. Case No. 195 of 2018, G.R. No. 2923/2018 subject to the condition that the land in question shall not be transferred by the petitioner without prior permission of the trial court.
