JUSTICE SUDHIR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 302/120 (B) of the Indian Penal Code. It is alleged by the informant, Umesh Thakur, that on 10.10.2015 his son Raja went to Narauli for plying vehicle and thereafter his neighbour Lal Babu Sahni took Raja from Narauli . It is further alleged that Raja went somewhere else by the motorbike of Lal Babu Sahni and returned back at 9 P.M. and parked the motor bike at the residence of Lal Babu Sahni where Suraj Sahni was also present and they took the son of the informant in their custody and killed him in the night hour and kept the dead body in a hut. In the night when Anita Devi, wife of the informant saw Raja lying on a Chauki she called him but no reply was given and she reached there but found him dead.

Patna High Court Cr.Misc. No.17988 of 2016 (3) dt.25-05-2016 2/2 It is submitted on behalf of the petitioner that the petitioner is in custody since 26.10.2015. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. As per prosecution case there is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner in the present case and only suspicion has been raised against the petitioner on the ground of enmity.

On behalf of the State and the informant, it is submitted that the petitioner is named in the FIR and he has conspired in commission of the crime.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge 3rd - cum- A.C.J.M, Muzaffarpur in connection with Mushahari P.S.Case No. 170 of 2015.
