The petitioner seeks bail in a case under Section 307, 436, 353, 452 and other sections of the Indian Penal Code and under section 52 of Prisoner Act.

In sum and substance the allegation is that the petitioner and one Santosh Jha were to be shifted from Sitamarhi jail to some other jail but at the instigation of the petitioner the prisoners of his group made protest and set ablaze many articles inside the jail and also damaged store room etc. No specific allegation is made against the petitioner except that petitioner instigated the men of his group.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.28380 of 2015 (2) dt.05-08-2015 2/2 allegation made against the petitioner and the fact that petitioner is in jail since 11.03.2015, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Dumra P.S. Case No. 285/14.
