The petitioner is languishing in custody since 05.05.2015 in a case registered for the offences punishable under Sections 341, 342, 504, 354 of the Indian Penal Code and 3(1) (xi) of SC/ST (Prevention of Atrocities) Act.

It is alleged that the informant was waiting on road for her associate, in the meantime, petitioner caught hold her hand and tried to outrage her modesty by taking her to an orchard which was objected by the informant by raising alarm whereupon her associate Hira Devi and others came then the petitioner escape from the scene.

It is submitted by learned counsel for the petitioner that for the occurrence of 23.09.2014 the FIR has been

Patna High Court Cr.Misc. No.27770 of 2015 (02) dt.30-06-2015 2/2 maliciously lodged on 28.09.2014. The husband of the informant filed Bahera P.S. Case No. 137 of 2015 making accusation under SC/ST Act at earlier point of time. It is further submitted that the informant and her husband are domestic help of the brother of the petitioner with whom the petitioner is contesting Title Suit No. 60 of 2014 as a result the brother of the petitioner set up the informant to lodge the present case.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S. Case No. 412 of 2014.
