The petitioner is in custody since 06.02.2016 in connection with a case registered for the offences punishable under Sections 147/148/149/323/341/302/307 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though it is alleged that the petitioner had fired on one Bishwanath Rai, the injury belies the prosecution case as no fire-arm injury has been found on the person of the said Bishwanath Rai.
