Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 22-06-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in Rahika P.S. Case no. 04/2022 registered for the offence punishable under Sections 272, 273/34 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act.

Allegedly, 1350 liters Nepali liquor kept in 4500 bottles was recovered from a pick up van vehicle and petitioner and co-accused were arrested from the said vehicle. The main submissions advanced by the learned counsel for the petitioner are that there is no criminal antecedent against the petitioner, he has been languishing in jail since 07.01.2022, he is simply owner of the alleged vehicle due to which he has been falsely roped in this case and he has no concern with the alleged seized liquor.

Heard both sides and perused the FIR and seizure of the alleged liquor. From a pick up vehicle huge quantity of Nepali liquor was recovered and the petitioner has claimed himself to be owner of the said vehicle and was arrested from the said vehicle. Considering these facts, this Court does not find it a fit case of bail at this stage and accordingly, his prayer for bail stands rejected.

Petitioner may renew his prayer for bail after framing of the charge, if the same has not been done till now. (Shailendra Singh, J) s.hassan/- U T
