Petitioner apprehend his arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 379, 406, 420, 504/34 of the Indian Penal Code.

It is alleged that this petitioner had taken Rs. 61,66,000 as a loan from the informant to do business. After sometime the informant demanded his money back from the accused persons but they refused. After that a Panchayati was held in which the accused agreed to register his land, situated near Sundarpur road, to the informant and he also issued two cheques of Rs. 1 lakh each to the informant. On 05.08.2022, this petitioner went to Registry Office Raxaul but the accused

Thereafter on 27.09.2022 at about 8:30 o'clock the accused persons surrounded the informant and assaulted and tried to kill him with knife. Petitioner gave knife blow on informant's head in which he became unconscious. Learned counsel for the petitioner submits that he has never taken money from the informant. There is no chit of paper on record to substantiate the allegation. The present case is counter blast of Raxaul P.S Case No. 459 of 2022 which was lodged by the wife of petitioner against the informant and his brother. It is further submitted that doctor has found simple injury. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari . in connection with Raxaul P.S. Case No. 463 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
