Petitioner seeks bail in a case registered under sections 413, 414, 34 of the Indian Penal Code. The informant has lodged the present case against the petitioner and other co-accused alleging therein that on the date of occurrence , he received confidential information that stolen wrist watch from Kanat Place, Delhi can be recovered if home of other co-accused namely Santosh Kumar in village Bijbani will search. Upon this information the informant constituted a raiding party and caught hold Santosh Kumar and on his disclosure wrist watches were recovered.
On behalf of the petitioner it is submitted that
Patna High Court Cr.Misc. No.27524 of 2015 (2) dt.31-07-2015 2/2 petitioner is in custody since 09.04.2015. It is submitted that nothing is said to have been recovered from the possession of the petitioner. Other accused persons have been granted bail vide Cri. Misc. No. 10812 of 2015 and Cri. Misc. No. 20520 of 2015. It is submitted on behalf of the State that petitioner is named in the first information report. Considering the aforesaid fact, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,00/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Sudhir Sinha, J.M. Iszt Class, Sikarhana at Motihari in Ghorasahan (Jiitna) P.S. Case No. 382 of 2014.
