JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. One mobile phone is said to have been recovered from a vehicle which had been used by the culprits in commission of the present crime and when the call details of aforesaid mobile was verified, it was found that petitioner had also talked with the owner of aforesaid mobile and on the basis of aforesaid material, the house of the petitioner was raided and he was arrested from his house and Rs. 12,000/- is said to have been recovered from conscious possession of the petitioner. Petitioner is in jail custody
Patna High Court Cr.Misc. No.19022 of 2016 (2) dt.05-05-2016 2/2 since 17.01.2016 but up till now, he has not been put on Test Identification Parade. Moreover, having more or less similar allegation, one co-accused, Praveen Kumar @ Lalua has already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sheikhpura in connection with Ariyari P.S. Case No. 01 of 2016.
