The petitioner seeks regular bail in connection with Barun P.S. Case No. 209 of 2018, instituted for the offence under Sections 302, 201, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submitted F.I.R. is against unknown. It is alleged in the written report that on 31.10.2018 while informant Chowkidar was returning to his house after performing his night duty reached near Chimney Bhatta of Santhua More, he saw some persons had assembled near bush, he found a person dead body was lying in the bush. Learned counsel further submits that petitioner has been made accused on the basis of confessional statement of one co-accused Pawan Kumar Singh and Pawan Kumar Singh has been granted bail by a co-ordinate Bench of this Hon'ble Court vide Cr. Misc. No. 47336 of 2019 vide order dated 05.08.2019. One similarly situated person Sunny Kumar who has already granted bail by lower Court vide Annexure-2.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail application of the petitioner. Considering the fact that the petitioner is in custody since 26.10.2021, charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 209/2018.
