2. The petitioner seeks bail in connection with Udwantpur P.S. Case No. 383 of 2023 registered for the offence under Section 21(b)/29 of the Indian Penal Code.

3. As per the prosecution case, recovery of 110 Gms. of Brown Sugar (Heroine) was made from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has clean antecedent and he is in jail since 05.09.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the fact that the recovery is of intermittent quantity and also considering the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-I, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 383 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Jagdishpur Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
