Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Charpokhari P.S. Case No. 190 of 2022, NDPS 98/2022 registered for the offence under Sections 8 and 20(b)(ii)(c) of the NDPS Act.
As per prosecution story, the informant who is a police officer received a secret information that one Sitaram Sah is going towards Baligaon from Manaini with a bag full of Ganja and after this the informant proceeded on the government vehicle along with other police personnel for verifying the same and at about 08.40 he reached near the house of Surya Nath
Patna High Court CR. MISC. No.7218 of 2023(2) dt.16-05-2023 2/2 Sharma and started checking the movement of the vehicle and meanwhile he found that a person coming on a motorcycle who after seeing the police force, left his motorcycle and started running away with bag. The informant chased him and apprehended and on interrogation he disclosed his name as Sitaram Sah.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 30.09.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the aforesaid facts, this application for regular bail is rejected.
The Trial Court is directed to expedite the trial of the petitioner.
