Learned counsel for the petitioners submit that the case of the petitioners is fully covered by the judgment passed by this Court in C.W.J.C. No.985 of 2015 dated 27.03.2019.

These petitioners have also been deprived of the benefits to which they were entitled by the impugned resolution dated

Patna High Court CWJC No.1764 of 2019(7) dt.15-05-2024 2/2 31.08.2013 which had already been quashed to the extent as indicated in the judgment dated 27.03.2019 passed in C.W.J.C No.985 of 2015 by a Division Bench of this Court. Therefore, the petitioners are also entitled to the same benefits on the same terms. 4.

In that view of the matter, this writ petition is disposed of with a direction to the petitioners to file a fresh representation before the respondent no.8, along with a copy of the order passed in C.W.J.C. No.985 of 2015, before the respondent no.8 and the respondent no.8 is well advised to consider the case of the petitioners and dispose of the representation of the petitioners after affording an opportunity of personal hearing or through their counsel and pass a reasoned and speaking order in accordance with law and in light of the order passed in C.W.J.C. No.985 of 2015 within three months from the date of filing of such representation by the petitioners. 5.

It is made clear that respondent no.8 shall be personally held responsible for non-compliance of this order within the stipulated period.
