Petitioner is accused in connection with Maheshi P.S. Case No. 08 of 2015 registered under Sections 147, 148, 149, 341, 307 and 324 of the I.P.C. and 27 of the Arms Act. The accusation is that Rajesh Sada, brother of the informant, was accompanied by Sonu Jha, Niraj Jha and Raju Kumar Jha for entertaining the dance program. In the way, Bhagwan Ram, Nitish Jha, Ashutosh Kumar and the petitioner surrounded the brother of the informant and started to assault. In that course, due to dispute with Sonu Jha and Niraj Jha, Bhagwan Ram shot fired at his brother causing injury at his stomach.
Patna High Court Cr.Misc. No.17893 of 2016 (2) dt.03-05-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. The specific overt act has been attributed against co-accused Bhagwan Ram. Further submission is that petitioner is in custody since 02.02.2016. It is also submitted that petitioner is accused in three other cases, as detailed in paragraph no.3 of the petition, but in that cases, he is on bail.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Saharsa in connection with Maheshi P.S. Case No. 08 of 2015 . (Rajendra Kumar Mishra, J) Shail/- U T
