Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 10.10.2017 passed in Cr. Misc. No.40523 of 2013.

Allegation is about recovery of 1kg. and 100 gram of opium from his possession.

Submission of the learned counsel for the petitioner is that the recovery is less than the commercial quantity. The petitioner is in custody for more than two years and up till now no substantive progress has been made. . Heard learned A.P.P. and the learned counsel for the

Patna High Court CR. MISC. No.11112 of 2019(3) dt.04-04-2019 2/2 Central Government. From perusal of the report it appears that only one witness has been examined up till now.. In such view of the matter, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ VIII, Gaya in connection with NCB/PZU/V/09/17 corresponding to NDPS Case No.04/17 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled and further condition that one of the bailors should be local one having sufficient property within the jurisdiction of the court concerned and further before releasing the petitioner, his address may be verified and his bailors' address shall also be verified..

With the aforesaid direction, this application is allowed.
