In this case, the petitioner is seeking bail in connection with Chakia P.S. Case No. 41 of 2013 (G.R. No. 634 of 2013) registered for offences under sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act. As per First Information Report, 15-20 unknown persons entered into the house after breaking the door and started biting and looting the article. After looting the material, they fled away. The name of the petitioner has transpired during investigation. The petitioner has been remanded in this case after 2.5 years and other one person, namely, Bachchan Raut has been granted bail by order dated 21.4.2014 in Cr. Misc. No. 7903 of
Patna High Court Cr.Misc. No.18391 of 2016 (2) dt.03-05-2016 2014. Jildar Rai @ Dildar Rai has been granted bail by order dated 15.10.2014 in Cr. Misc. No. 39220 of 2014. Laxman Ram has been granted bail by order dated 15.10.2014 in Cr. Misc. No. 40837 of 2014. Gumani Rai @ Gumasta Rai has been granted bail by order dated 5.2.2015 in Cr. Misc. No. 4955 of 2015. Sone Lal Sah has been granted bail by order dated 11.6.2015 in Cr. Misc. No. 20101 of 2015 and Ram Bahadur Sahani and one another has been granted bail by order dated 11.6.2015 in Cr. Misc. No. 24062 of 2015.
Looking to the facts and circumstances of the case, let the petitioner, namely, Ravindra Sahani, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chakia P.S. Case No. 41 of 2013 (G.R. No. 634 of 2013), subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below.
