JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioner is languishing in custody since 11.05.2013 in connection with Barachatti P.S. Case No. 215 of 2013 for the offences instituted under Section 414 of the Indian Penal Code and Section 25 (1-b)a and 26 of the Arms Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 11.05.2013 the informant got secret information to the effect that notorious criminal Baldeo Singh Bhokta (petitioner) has come in his house with looted motor cycle and is drinking toddy. The informant along with police party reached there and conducted raid on the house of the petitioner and found one person hidden under cot and on search, a country made loaded pistol has been recovered from his waist. On being asked, he disclosed his name as Baldeo Singh

Patna High Court Cr.Misc. No.15798 of 2015 (2) dt.08-06-2015 2/2 Bhokta. One Hero Honda motor-cycle of red colour has also been found in the room regarding which no paper has been shown, hence the same has also been seized and accordingly, seizure list has been prepared.

It has been submitted on behalf of the petitioner that when the petitioner was apprehended, a country made loaded pistol is said to have been recovered from the possession of the petitioner. It has further been submitted that the petitioner is in custody since 11.05.2013.

It has been submitted on behalf of the Stat that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghaty (Gaya) in connection with Barachatti P.S.
