Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 498(A),
Patna High Court CR. MISC. No.8868 of 2023(2) dt.24-04-2023 2/3 376, 511/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
It is a case of dowry.
As per the prosecution case, the husband and in-laws of Manita Devi (informant) harassed her mentally and physically for demand of dowry of Rs.1 Lac and one color television.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners and no specific overt act has been alleged against them. Petitioner no.1 is father-in-law, the petitioner no.2 is mother-in-law, the petitioner no.3 Dewar, the petitioner no.4 is Gotini, the petitioner no.5 is Nanad of the informant while petitioner nos.6 and 7 are relatives of the informant's husband. They are separate in mess and business and these petitioners have no concern with Shyam babu Manjhi, the husband of the opposite party no.2 because they all are living separately. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each
Patna High Court CR. MISC. No.8868 of 2023(2) dt.24-04-2023 3/3 with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra in connection with Chapra (Muffasil) Police Station Case No.383 of 2022 subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
