The petitioner seeks his bail in Bodhgaya P.S.Case No.45 of 2015 registered under Sections 302/34 of the Indian Penal Code. The informant alleged that the petitioner along with others assaulted the son of his Sarhu, who succumbed at the hospital. It has been submitted that the petitioner has been named in the present case only on suspicion as neither there is any specific overt act nor any specific injury has been attributed against him. The petitioner has no criminal antecedent and is in custody since 10.2.2015. On behalf of the State it has been stated that the petitioner is named in the FIR.
Considering the facts aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S.Case No.45 of 2015.
