The petitioners are languishing in custody since 24.03.2015 in a case registered for the offences punishable under Sections 365 and 120B/34 of the Indian Penal Code. The prosecution case is that the elder brother of the informant, namely, Prashant Bharti was kidnapped by Arun Kumar Singh, Ramawtar Singh, Malik Yadav and Sikandar Yadav. It is further alleged that earlier Arun Kumar Singh came with the proposal of marriage of his daughter with the victim. The petitioners were apprehended when they came to the house of the girl after the recovery of the captive Prashant Bharti.
Patna High Court Cr.Misc. No.26894 of 2015 (2) dt.28-07-2015 2/2 It is submitted by learned counsel for the petitioners that the petitioners are maternal uncle and cousin of the girl with whom the victim was married. Moreover, the investigation has already concluded.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Begusarai in connection with Sahebpur Kamal P.S. Case No. 130 of 2015.
