The petitioner seeks bail in connection with Yogapatti P.S. Case No.64 of 2015 registered under Sections 366(A)/34 of the Indian Penal Code.

The allegation of the informant, Ramdeo Sah, is that on 02.03.2015 in the evening his both daughters, Minka Kumari and Rina Kumari, had gone to attend the call of nature and when they were returning in that course, his one daughter, Rina Kumari, was forcibly kidnapped by this petitioner with the help of his cousin brother, Anil Ram, and Rajdeo Ram in the way on a motorcycle. No.26591 of 2015 (3) dt.07-10-2015 2/2 named three persons as the kidnappers of his daughter but the victim, Rina Kumari, in her statement recorded under Section 164 of the Code of Criminal Procedure disclosed the name of ten persons including the petitioner saying that Rajdeo Ram was sitting on motorcycle and all of them made her to sit over in the middle of the motorcycle and took her away by tying her mouth with towel and eyes with hanky and the petitioner sat behind her in the rear seat of the motorcycle. She has not stated regarding any assault or sexual assault by this petitioner or others. It is further submitted that on medical examination of the victim, her age has been assessed above 19 years and the co-accused, Rajdeo Ram, has already been granted bail by a coordinate Bench of this Court vide order dated 27.07.2015 passed in Criminal Misc. No.26731 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Yogapatti P.S. Case No.64 of 2015.
