The petitioner has filed this M.J.C. for restoration of CWJC No.8408 of 2008 which was dismissed for non-prosecution on 04.02.2017.

The learned counsel for the petitioner submits that on the ground of bereavement in the family, the petitioner could not come. It is submitted that on the death of mother of the learned counsel for the petitioner, the learned counsel could not appear. Taking into consideration the facts aforesaid, M.J.C. is allowed.
