The petitioner seeks regular bail in connection with Rajepur P.S. Case No. 132 of 2021, instituted for the offences under Sections 25(1-b)a, 26, 35 of the Arms Act. Allegation against is of recovery of one country made pistol and live cartridge and one empty cartridge. Learned counsel for the petitioner submitted that petitioner is in custody since 12.09.2021, charge-sheet has been submitted and petitioner is innocent and he has falsely been implicated in this case. Learned counsel further submits that there is no independent witness in this case and seizure witness has not been examined in 161 Cr.P.C. The fact of the case that there is land dispute between co-accused namely Vijay Yadav

Patna High Court CR. MISC. No.5408 of 2022(2) dt.08-06-2022 2/2 and the petitioner. One co-accused Jaga Ray had already been granted bail by a co-ordinate Bench of this Hon'ble Court vide Cr. Misc. No. 3327 of 2022 dated 26.05.2022.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail application of the petitioner. Considering the fact that the petitioner is in custody since 12.09.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, East Champaran at Motihari in connection with Rajepur P.S. Case No. 132 of 2021.
