JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 27.03.2015 in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
On recovery of wheat and rice from a vehicle, the FIR was lodged against the unknown. Name of the petitioner sprang up during investigation as an agent of PDS dealer. It is submitted by learned counsel for the petitioner that the petitioner is not the PDS dealer, hence no offence under Section 7 of the Essential Commodities Act is made out against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, the investigation has already concluded.
Considering the aforesaid facts, let the above named
