Petitioner in the present case is seeking regular bail in connection with S. Kamal P.S. Case No. 360 of 2019 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 07.12.2019 having no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

No.3689 of 2020(2) dt.21-01-2020 2/3 Considering the submission of learned counsel for the petitioner that the alleged illicit liquor has been recovered from the open place and it is said to be the cluster of the bamboo on the field of the petitioner but it is a lonely place, the petitioner has no criminal antecedent and has remained in custody since 07.12.2019, let on completion of the statutory period of investigation the petitioner above named be released on bail in connection with S. Kamal P.S. Case No. 360 of 2019 on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd-cum- Special Judge, Excise Act, Begusarai, subject to the condition as laid down under Section 437 (3) Cr.P.C.
