JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-08-2022 When the case is called out, nobody appears on behalf of the petitioners. However, learned APP for the State is present. Perused the entire record including the case diary. Learned counsel for the petitioners is directed to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 149, 341, 323, 325, 307, 504 and 506 of the Indian Penal Code.
Patna High Court CR. MISC. No.5378 of 2022(3) dt.29-08-2022 2/2 Allegedly, all the FIR named accused persons including the petitioners forming an unlawful assembly, lashed with arms attacked the informant and his father and assaulted them. Petitioners have two criminal antecedent, which is mentioned in para-3 of this application. Vide order dated 26.07.2022, case diary and injury report was called for and on perusal of the same, it is apparent that the injuries sustained by the victim are simple in nature.
Having regard to the facts and circumstances of the case, since the injuries are simple in nature, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Bachhwara P.S. Case No.109 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
