JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-05-2023 Heard learned counsel for the petitioners, learned counsel for the informant as well as learned APP for the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 327, 307, 384, 388, 504, 506, 34 of the Indian Penal Code and section 27 of Arms Act.

Learned counsel for the petitioners is permitted to correct the para-9 and 10 of the bail application in course of day. Petitioner no.1 demanded Rs.1 lakh as ransom from the informant and petitioner no.2 assaulted the informant by leg, fist and slaps.

It is submitted by learned counsel for the petitioners that

Patna High Court CR. MISC. No.7575 of 2023(3) dt.16-05-2023 2/3 petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that no person got injured in the present case and similarly situated co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No.5295 of 2023. He further submits that the bail application of the petitioners was pending in this Court when the process under section 82 and 83 of Cr.PC issued against the petitioner. Petitioners have no criminal antecedent. Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail and submits that process under section 82 and 83 of Cr.PC has been issued by the learned Court below.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in

Patna High Court CR. MISC. No.7575 of 2023(3) dt.16-05-2023 3/3 connection with Yogapatti (Nawalpur) P.S. Case No.433 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
