JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Learned counsel for the petitioner is permitted to make necessary correction in paragraph no. 1 of the petition. The petitioner is languishing in custody since 08.04.2015 in connection with Madhepura P.S. Case No. 194 of 2015 for the offences instituted under Sections 147, 357, 341, 342, 323, 307, 379 and 427 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 08.04.2015 at 5.30 P.M., the petitioner and other co-accused persons as named in the F.I.R. intercepted the car, which the victim injured was driving, by stopping their motor-cycle in front of the car and the

No.26529 of 2015 (2) dt.28-07-2015 2/3 petitioner attacked on the informant by Iron rod and brought him out from the car by damaging the gate of the car and further coaccused persons namely Raju Kumar and Sonu Kumar attempted to abduct the children of the informant by lifting them from the vehicle and when objected then the petitioner and other coaccused persons assaulted Khokha Yadav, who was also sitting with the informant in the car, by iron rod causing serious injuries to his head and eyes and in the meantime co-accused Kumarji snatched silver and gold ornaments worth Rs. 5,000/- from the body of the informant. It has been further alleged that the petitioner and other co-accused persons threatened the informant and attempted to abduct the children but in the meantime, on hearing alarm many people assembled there and protested then the accused persons fled away but the local people caught hold the main accused Ravi Kumar petitioner and handed over him to the police.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.04.2015 and the charge sheet has been submitted in the present case for the offence under Section 379 and other allied Sections of the I.P.C. It is further submitted that case has been found to be false under Section 307 of the I.P.C. As per allegation, the main allegation is against Sonu Kumar and

On behalf of the State it has been submitted that altogether 11 persons including the petitioner have been named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura, in connection with Madhepura P.S.
