JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

It is a serious case of dacoity but admittedly, the First Information Report was lodged against five unknown persons and in course of investigation the name of petitioner surfaced in confessional statement of co-accused persons. Subsequently, petitioner was arrested and sent to judicial custody on 11.01.2016 but except the aforesaid confessional statement of co-accused and criminal antecedent of the petitioner, there appears to be nothing against him.

Moreover, the investigation against the petitioner

Patna High Court Cr.Misc. No.18825 of 2016 (2) dt.03-05-2016 2/2 appears to have already been completed.

Accordingly, petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Maheshkhut P.S. Case No. 132 of 2015, G.R. No. 2645 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Khagaria.
