The petitioner apprehends his arrest in connection with Siwan Mahila P.S. Case No. 74 of 2018 registered under Sections 376D of the Indian Penal Code, Section 3(2) V(a) of the SC/ST (prevention of atrocities) Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Petitioner is not named in the F.I.R. There is no medical report of the alleged occurrence. Further submission is that similarly situated co-accused person has already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Appeal (SJ) No. 3068 of 2019 on 20.11.2019. Having considered the facts and circumstances of

No.4365 of 2020(3) dt.30-06-2020 2/2 the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bail bond to the satisfaction of the Additional District and Sessions Judge-I-cum-Special Judge, Siwan in connection with Siwan Mahila P.S. Case No. 74 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
